ميثاق روما للمحكمة الجنائية الدولية 0عادة ما يشار إليها بميثاق المحكمة الجنائية الدولية أوميثاق روما)، هي معاهدة تأسس بموبها المحكمة الجنائية الدولية. اعتمدت في مؤتمراً دبلوماسياً عُقد في روما في 17 يوليو1998 ودخلت حيز التطبيق في 1 يوليو2002. اعتباراً من مارس 2019، كان هناك 124 دولة عضوفي الميثاق. من بين أمور أخرى، يحدد الميثاق مهام المحكمة، الاختصاص والتنظيم.
تأسس بموجب ميثاق روما أربع جرائم دولية أساسية: الإبادة الجماعية، الجرائم ضد الإنسانية، جرائم الحرب وجرائم العدوان. "لا تخضع هذه الجرائم لأي قانون تقادم". بموجب ميثاق روما، فغن المحكمة الجنائية الدولية هي المحكمة الوحيدة المنوطة بالتحقيق في الجرائم الدولية الأساسية الأربعة ومقاضاة مرتكبيها في الحالات التي تكون فيها الدول "غير قادرة" أو"غير راغبة" في القيام بذلك بنفسها؛ الاختصاص القضائي للمحكمة مكمل لاختصاص المحاكم المحلية.قد يكون للمحكمة اختصاص على الجرائم فقط إذا ارتكبت في دولة عضوفي الميثاق أوإذا ارتكبها مواطن من دولة عضو؛ استثناء هذه القاعدة هوحتى المحكمة الجنائية الدولية قد يحدث لها أيضًا اختصاص على الجرائم إذا كان اختصاصها مخول به من قبل مجلس الأمن الدولي.
